These Terms and Conditions of Sale (T&C) apply to all purchases of products or services made by any natural or legal person (hereinafter referred to as "the customer" or "you" as appropriate) from Swiss Recycling Metals Sàrl (hereinafter referred to as "Swiss Gold Services" or "us" as appropriate), via the website www.SwissGoldServices.com (and all sub-domains), through any other remote communication channel, or in person. Swiss Gold Services is the seller of all products and services.
You acknowledge that all contracts, notices, information communications and other exchanges carried out electronically comply with the legal requirements that such exchanges be made in writing. Any verbal agreement between you and us must be confirmed in writing; otherwise it shall have no legal effect.
Swiss Gold Services reserves the right to modify these T&C at its sole discretion; the applicable terms are those in force on the website at the time your order is placed.
The binding version of these T&C is the French original. The original French-language version shall prevail over any translation into other languages.
In addition to these T&C, special provisions apply to certain products or services: our jewellery buy-back service (gold bars, dental gold, coins, watches, etc.) is governed by the General Terms and Conditions for Precious Metal Buy-Back.
You must be legally authorised to open a customer account (i.e. you must have reached the legal age of majority, have full legal capacity, and not be under legal guardianship or curatorship).
If you reside outside France, please check before selling your jewellery whether your country permits the export and resale of precious metals; Swiss Gold Services cannot be held liable if a seller breaches the legislation of a foreign state.
If you reside in France, you are subject to applicable taxes and reporting obligations. Swiss Gold Services handles the required declarations on your behalf with the relevant authorities.
If you reside abroad, you are subject to taxes and reporting obligations in your country of residence. You are required to declare the sale of precious metals. Our company accepts no liability for non-declaration.
We decline all commercial relations with persons of American nationality or residing in the United States of America.
Currencies — displayed price and invoiced price: prices shown on our invoices, and by default on our website, are always stated in euros (EUR). However, prices may be displayed on the site in Swiss francs (CHF) or US dollars (USD) for indicative purposes only.
The consumer has a right of withdrawal, which may be exercised within 48 hours of signing the contract, except for investment gold transactions.
Exercising the right of withdrawal entails the consumer reimbursing the seller for the purchase price, and the seller returning the item to the consumer.
In the event that Swiss Gold Services is unable to return the purchased item, we will pay the consumer twice the sale price received for that item.
1. Data protection: the discreet and secure handling of your personal and commercial data is guaranteed. Swiss Gold Services complies with applicable data protection legislation. For details on data security measures, please refer to the Privacy Policy page.
2. We undertake to apply all professional standards in the delivery of the service offered to the customer. However, our liability cannot be engaged in the event of a failure to meet our contractual obligations due to an unforeseen event or force majeure.
If one or more provisions of these T&C are or become invalid or unenforceable under applicable law or by court decision, such provisions shall apply only to the extent permitted by applicable law. The remaining provisions shall remain valid and fully enforceable.
